It is possible for Australian citizens, permanent resident and eligible New Zealand Citizens to sponsor a partner to stay permanently in Australia. The sponsorship can be based on marriages solemnised in Australia or overseas as long as that marriage was recognised under that country’s laws. On another hand, a partner sponsorship can also be based on a de facto relationship as long as you can show that you are in a genuine relationship for at least twelve(12) months.
Basic Criteria
To be considered in this visa, a person must show that s/he is in a genuine relationship (either marriage or de facto) with another person and that they have “ mutual commitment to a shared life with the exclusion of all others”.
Generally, you must prove your relationship by showing evidence in the following areas: financial aspects, nature of the household, commitment to each other and the social aspects.
Married applicants
The marriage must be recognised under the Australian law. Generally, all marriages which are recognised another country may also be recognised in Australia. However, marriages that involve under age people , polygamous relationships are considered illegal in Australia. Same-sex marriage is not recognised in Australia at the moment.
De-facto partnerships
People who are in a de facto relationship may be eligible to apply for a partner visa. The basic requirement is the couple must have lived for at least one(1) year as de facto partners. But there are relationships which below one(1) year old that maybe considered provided that they have a compelling circumstance such as having children of their own or if the relationship is registered in a state.
The sponsor
The sponsor is someone who is an Australian resident, citizen or an eligible New Zealand citizen. The sponsor has obligations or undertaking which must be complied with.These obligations pertain to accommodations and financial support to the applicant in the first two(2) years of visa grant.
Dependent Children
Applicants for partner visa may include their dependent children that they naturally want to take with them to start a new life in Australia.
Processing time
Generally, partner visas are processed in approximately three(3) years depending on several factors.
It is possible for international students who have completed their Australian degree under a student Visa Subclass 573 or higher to extend their stay in Australia by applying for a further visa. These visas may offer them a pathway to permanent residency depending on their circumstance.
GENERAL SKILLED MIGRATION : This visa can explore their options in this category provided that they can meet the requirements of this Skilled Visas.
Independent skilled migration
This visa option is available for skilled workers overseas who can prove that they have skills that are equivalent or recognised in Australia. Apart from that, a person may be eligible depending on the following : age, English language ability, the nomination of a particular skill and being assessed as equivalent to Australian qualifications and must pass the points test ( minimum Sixty(60) points.
Regional sponsored – skilled
if you are a skilled professional or a tradesman, a family sponsored migration is another option. This visa allows an applicant to be sponsored by the state or their relatives to live and work in designated areas usually in the same area where the family members live.This visa entitles the applicant to live and work in Australia for at least four(4) years.
For state sponsored skilled migration, an applicant must pass the state sponsorship assessment requirements and be approved for state sponsorship.These visa options require an applicant to pass the Points Test and be invited to apply.
GRADUATE VISA / POST STUDY WORKSTREAM : These are visas available for students who completed their studies in Australia . Additionally, they are popular among students because these visas allow them to practice their profession in Australia after their completion of their studies in Australia.
For post-study work stream , a student is eligible to apply for this if the first student visa has applied or was granted a visa on or after 5 November 2011. These students do not need to nominate an occupation under skilled occupation lists(SOL).
Depending on the level of education completed, the student can stay in Australia from 2 to 4 years.
For Graduate Visa, the student must nominate an occupation under the Skilled Occupations Lists and must have been given favourable assessment by the relevant authority. For holders of Graduate Visa, these students can extend their stay in Australia for 18 months.
The students are however not required to meet the points test for these visas.
OPTION: PARTNER or SPOUSE VISA

The skilled visa program is available to skilled workers or professionals who can prove that they have the right set of qualifications that are equivalent or recognised in Australia. These skills can be professionals like doctors, nurses, accountants, engineers or trade occupations like carpenters, welders, auto-mechanic and the list of occupations can be found on the skilled occupation list (SOL) or the consolidated sponsored occupations list (CSOL). In summary, prospective applicants must generally meet the following:
Registered nurses general requirements:
- Must be registered in the country where degree was conferred.
- Must have at least 3-6 months of relevant experience.
- May need to undergo a IRON Bridging program in Australia. The cost of this program would be around A$20,0000 including tuition fees but excluding airfare and cost of living.
Registered Occupational Therapists (OT) general requirements:
- Must be registered in the country where degree was conferred.
- Must have at least 3 -6 months relevant experience.
- Must have been educated in a WFOT accredited university.
Professional Engineers general requirements:
- Must be registered in the country where degree was conferred.
- Must have at least 1 year relevant experience but 3 years experience is recommended.
Other General Requirements
- Age limit of less than 50 Years old – the migration age of between 18-44 is eligible to be awarded corresponding points.
- Nominate a skill under the skilled occupation lists (SOL) – an applicant must choose the appropriate occupation on the list or closely related occupation. After nominating an occupation the applicant may not be able to change this. In the case of state-sponsored visas, the applicant must nominate under the state-sponsored occupation list (SSOL) of the relevant state. Each state has their own unique occupation lists.
- Pass the Australian visa points test as prescribed by law- the minimum points that the applicant must possess at the time of invitation is sixty (60) points.
- A positive skills assessment from an Australian relevant authority- this requirement is essential as it indicates that the applicant has a background similar to the Australian qualifications.
- Pass the character test and health checks– these are essential requirements. A failure of one of them may result in a visa refusal.
- Provide evidence of acceptable English language ability -there are several English exam results which are now acceptable for migration purposes. The most popular are the following: a. IELTS b. PTE Academic c. OET Although applicants are only required to have “competent” English, only a person with “proficient” (for example, a score of “B” on OET), or “superior” English ( for example, a score of 79 on PTE Academic) will be awarded points on the points test. Lastly, any English exam scores considered to be less than “competent”, it will not meet the eligibility requirement for this visa.
- For state-sponsored skilled visa subclass 190 and state-sponsored skilled visa subclass 489, the state must approve the sponsorship at the time of application.
- For family-sponsored regional sponsored subclass 489, an applicant must have a prescribed relative living in a designated area.
- Please note that this permanent visa allows the applicant to bring the immediate family member such as a spouse, children and others.
This visa is for people who wants to visit Australia for tourism purposes or business purposes or for a family visit. Generally, people on this visa can enter and remain in Australia up to 3 months or sometimes longer if the applicant’s circumstance compels them to stay for that long.Generally speaking, people who apply for visitor subclass 600 are required to prove that they are genuine tourists,they have great reason to return home to their home country and that they have enough funds to support their travel. For any applicant, it is to their advantage if they can provide compelling evidence to prove the points mentioned earlier.
The processing time for this the of visa can be as quick one (1) day to four (4) weeks and sometimes longer. It is advisable, though, to apply for the visa as early as possible. This is because an applicant will have the benefit of searching for better airline fares into Australia.It is also important to note that most people on tourist visa subclass 600 are not allowed to work and to study for more than three(3) months. A breach of this condition may be a ground for cancellation of visa and removal from Australia.
The student visa program is for people who wants to study in Australia through a CRICOS -registered education provider. There are various programs available ranging from ELICOS ( English Language Intensive Courses for Overseas Student), vocational and education sector, higher education courses.
What are the basic criteria for eligibility for this visa?
First, you must prove that you are a genuine student. It means that you have the sole intention to study. Secondly, you also need to satisfy that you will return to your home country at the end of visa period.
